Acceptable Use Policy

1. Scope
This Acceptable Use Policy governs everyone who accesses the ABY platform (account owners, users, and anyone acting under a customer account). Violating it may result in immediate suspension or termination, without refund, and may be reported to authorities where required.
2. You may NOT
- Use ABY for any illegal purpose, or in violation of transport, trade-sanctions, trafficking, or export-control laws.
- Send communications without required consent — including SMS/email to drivers or contacts for whom the customer has not obtained consent (see the driver-consent obligation in the ToS §4.1).
- Scrape, crawl, or harvest data by automated means except via ABY-provided APIs within their limits.
- Impersonate any driver, facility, carrier, or ABY personnel, or misrepresent your affiliation.
- Circumvent or probe security — bypass authentication, access data you’re not authorized to, or test vulnerabilities without written permission.
- Interfere with the service — overload, disrupt, or degrade the platform or its infrastructure (AWS).
- Upload malware or harmful code.
- Infringe IP or upload content you lack rights to.
- Resell or sublicense access without authorization.
3. Data & privacy responsibilities of customers
- The customer is responsible for having a lawful basis and any required consents for personal data it submits (driver names, phone numbers, emails).
- The customer must not upload special-category / highly sensitive data beyond what the service is meant to process. The Service is designed to collect Driver ID Data (driver’s-license / CDL / gov-ID) for yard access and verification (per ToS §4.5); customers must not submit Social Security numbers, financial-account, health, or GDPR Article 9 special-category data.
4. Enforcement
- ABY may investigate suspected violations and suspend access immediately where necessary to protect the platform, other customers, or third parties.
- Suspension/termination for a material AUP breach is without refund.
5. Reporting
Report abuse or security issues to security@abyplatform.com (or abuse@abyplatform.com).
6. Changes
ABY may update this AUP; material changes are notified and re-acknowledged in-app. Governing law: California.
7. Acceptance
This AUP is accepted per user at first login, distinct from the account owner’s ToS/DPA acceptance. Published at abyplatform.com/legal/aup and linked from the ToS.
